下圖為本案主要爭訟之授權圖片，之所以爭訟，是因為圖片使用者並未依循圖片授權者所要求之創用CC授權條款：使用者未標示圖片授權來源，亦未使用相同方式分享該圖片，更未標示創用CC授權條款。故德國法院以定暫時狀態假處分，強制圖片使用者依循該圖片之創用CC條款，本處分反映出德國司法實務對創用CC授權條款之肯定。...

創用CC授權至今推行逾十年，在此十年間已有超過數百萬計之創用CC作品問世。然而，在此十年間，很少聽聞因為創用CC授權作品而涉訟之消息。 本文中所引之判決：Lichôdmapwa v. L’asbl Festival de Theatre de Spa以及Avi Re’uveni v. Mapa inc[1]，可見各國實務肯定創用CC授權之法律效力，同時本文所指案件也可說明實務對於創用CC和著作權法之間是並存且不互斥的。
